1. Purpose of the Agreement

The Consultant is obligated to provide advisory and support services regarding the German Opportunity Card in accordance with Section §20 of the German Residence Act (Aufenthaltsgesetz).

2. Scope of Services

The Consultant will provide the following permitted advisory services:

• Consultation on the requirements and procedures for the Opportunity Card pursuant to the German Residence Act.
• Support in the recognition of foreign professional or educational qualifications (without influencing recognition decisions).
• Assistance in preparing application documents (CV, Letter of Motivation according to German standards).
• Translation services for required documents by certified translators.
• Information on language course providers to fulfill language requirements.
• Mediation of contacts to potential employers (without guarantee of job placement).

3. Excluded Services

The following services are expressly excluded:

• Influencing governmental decisions (recognition of qualifications, granting of the Opportunity Card).
• Guarantees for the success of application procedures.
• Legal advice or representation before authorities (does not include legal services provided by lawyers).
• Obtaining visas or any other services subject to special regulation under the Residence Act or the Legal Services Act (Rechtsdienstleistungsgesetz).

4. Client's Obligations

The Client is obligated to:

• Provide truthful information and original documents.
• Bear government fees themselves (fees are not processed through the Consultant).
• Submit applications personally (the Consultant does not represent the Client).
• Assume responsibility for the accuracy of all information provided.

5. Data Protection

Personal data is collected and processed in accordance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).

• Data is used exclusively for the execution of this agreement.
• It will not be shared with third parties without explicit consent.
• Right of access, rectification, and erasure according to Articles 15-17 of the GDPR.

6. Fees and Payment Terms

• All costs are transparent and correspond to the terms specified in this agreement.
• No success-based fees apply.
• Invoices are issued upon partial delivery of services.

7. Limitation of Liability

The Consultant's liability is limited to cases of intent and gross negligence. The company assumes no liability for decisions made by German authorities.

8. Term of the Agreement

• This agreement commences upon signature and ends upon completion of the agreed services.
• Either party may terminate the agreement with 14 days' written notice.
• In case of termination, fees for services already rendered are payable.

9. Final Provisions

• Amendments require written form.
• The place of jurisdiction is Ingolstadt.
• This agreement is governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods.

10. Official Email Address

The Client authorizes the Consultant to create an official email address in the Client's name, to be used solely for the purposes of managing the German Opportunity Card process and communicating with relevant official bodies.

• The email address shall remain associated with the academic and administrative process only for the duration of the application and service period.
• Upon completion of the Opportunity Card application process or termination of this agreement, the email address will be deactivated.
• The Consultant is prohibited from using the email address for any personal or other commercial purposes unrelated to the Opportunity Card services.
• The Consultant is obligated to maintain the confidentiality of the email contents during the period of its use for official purposes only.
