Medical Academic File Consultation and Support Agreement

1. Purpose
The Consultant undertakes to provide advisory and administrative/academic support services to doctors and students with medical qualifications, with the aim of facilitating the accreditation of their certificates, preparing their files, and applying for specialization or postgraduate programs in Germany.
2. Scope of Services
The Consultant shall perform the following:
- Certified Translation: Legally certified translation of medical and academic documents for German authorities.
- File Preparation: Reviewing and correcting required files (CV, motivation letters, certificates).
- Academic Consulting: Guidance on selecting medical specializations, Master's, PhD, and medical residency programs.
- Application Follow-up: Submitting and tracking applications with universities, medical associations (Ärztekammer), or relevant official bodies.
- Updates and Guidance: Providing continuous guidance throughout the application and accreditation period.
3. Obligations of the Student (Doctor)
The Doctor undertakes the following:
- Providing correct and accurate academic and medical documents.
- Adhering to deadlines and submitting all required documents.
- Verifying the accuracy of all data before uploading or signing any application.
- Assuming responsibility for any deficiency or error in the submitted documents.
4. No Guarantee of Admission or Recognition
- The Consultant does not guarantee final recognition or admission; decisions are issued exclusively by universities, medical associations, or the competent German authorities.
- The Consultant works to enhance the chances of success by preparing files according to required standards and applying to the appropriate institutions.
5. Confidentiality
Both parties commit to maintaining the confidentiality of the provided medical and personal information, which shall not be shared except when necessary for the purpose of application, or if disclosure is required by law.
6. Term and Termination
- This agreement remains in effect until the completion of the application and accreditation process.
- Either party may terminate the agreement with 3 days' written notice.
- Upon termination, the Student (Doctor) is obligated to pay for the services rendered up to the termination date.
7. Governing Law and Dispute Resolution
- This agreement is governed by German law.
- Any dispute shall first be attempted to be resolved through direct negotiation.
- If the dispute is not resolved, the parties may resort to mediation or legal proceedings in accordance with German law.
8. Entire Agreement
- This document represents the entire agreement between the parties.
- It may only be amended by mutual written consent.
9. Fees and Payment Terms
- All costs are transparent and comply with the terms specified in this contract.
- There are no success-based fees.
- Invoicing occurs after partial service delivery.
10. Data Usage Authorization
The Student (Doctor) authorizes the Consultant to collect, process, and use their personal and academic/medical data for the sole purpose of preparing files, translation, and submitting applications to universities, medical associations, and official bodies.
- The Consultant is not authorized to modify, forge, or create official documents (such as letters of recognition or acceptance).
- Data usage complies with all applicable data protection laws and is strictly limited to activities related to application and accreditation.
11. Creation and Use of Official Email
The Student (Doctor) authorizes the Consultant to create an official email address in the Student's name, to be used solely for the purposes of preparing academic/medical files, submitting applications, and communicating with universities, medical associations, or relevant official bodies.
- The email address remains linked to the academic/administrative process only for the duration of the application and services.
- Upon completion of the application or accreditation process, or upon termination of this agreement, the email address shall be deactivated.
- The Consultant is prohibited from using the email address for any other personal or commercial purposes unrelated to the application and accreditation services.
- The Consultant commits to maintaining the confidentiality of the email contents during the period of its use for official purposes only.
By agreeing to this agreement, you acknowledge the following:
- That you have read and understood all the above clauses.
- That your signature (electronic or written) is legally binding.
- That you agree to all the terms and conditions contained herein.
